Legislative challenges in labor matters for Nursing in Mexico
Keywords:
Health Law in Mexico, Official Gazette of the FederationAbstract
To guarantee the labor rights of nursing professionals in any country, it is necessary to establish labor policies that guarantee rights and obligations. The competent authorities for establishing regulatory proposals may be international or national. In the case of
Mexico, it should ideally be governed by the agreements of the International Labor Organization (ILO) and by the various National Standardization Advisory Committees. These committees are made up of representatives from the government, industry, academia, consumers, and other stakeholders to analyze and debate proposals before they are issued by the competent authority. As a result
of the agreement of these committees, Mexican Official Standard NOM-019-SSA3-2013 was established for the practice of nursing in the National Health System (2013). However, there are areas of opportunity to achieve fair and equitable legislation that regulates the professional practice of nursing, both in terms of rights and obligations and procedures for resolving conflicts and sanctioning non-compliance, both by professionals and their employers, to guarantee decent wages, jobs, and workspaces. However, the process of creating these legal norms by legislative bodies such as a parliament or other governing body has been delayed, a situation that affects the professionalization of nursing and its labor regulation
