The Problem of the Fundament and Validity of Human Rights
Abstract
This paper shows two of the standard narratives that seek to account, through a linear nature, for the birth of Human Rights that reaches its maximum expression in 1948. However, Hunt and Menke and Pollman make a strong criticism of this type of narrative for being reductionists. This places two central problems: the genesis and validity of Human Rights. In this way, the aforementioned authors formulate an alternative narrative that allows them to be founded. It is about compassion and sympathy for the other going hand in hand with two philosophical models: the contractualist model and that of reason.
